1. What is a public record?
A public record includes any information maintained by a governmental entity that is required to be kept as part of official business, regardless of format—this includes paper documents, emails, maps, photographs, recordings, and digital files.
2. How do I submit a public records request?
You can submit a request through the City’s online Public Records Request Portal, by email at [email protected], or in person at Cody City Hall 1338 Rumsey Ave.
3. Do I have to identify myself when submitting a request?
No. Wyoming law does not require you to provide your name or explain why you want the records, although providing contact information may help us clarify your request and deliver the records more efficiently.
4. How specific does my request need to be?
Your request must reasonably describe an identifiable public record. Requests that are too vague or broad may be denied or delayed. Staff can help you refine your request if needed.
5. How long will it take to receive the records?
Requests are often fulfilled prior to the statutory requirement of 30 days. If the request is complex or involves a large volume of records, it may take longer. Per W.S. § 16-4-202, you will be notified if fulfillment will exceed 30 calendar days.
6. Are there any fees for public records?
Yes. The City charges fees to recover the cost of staff time, copies, and electronic media. You will receive a cost estimate before any fees are incurred. Click HERE to see the fee schedule.
7. Can I just inspect records instead of getting copies?
Yes. You may request to inspect records during regular business hours. Some records may need to be retrieved or reviewed prior to inspection. Fees may apply.
8. What types of records are exempt from disclosure?
Some records are confidential and not subject to public release under Wyoming law, including:
- Communications protected by legal privilege (W.S. 16-4-203(d)(v)
- Information obtained through a 911 emergency system (W.S. 16-4-203(d)(x))
- Internal personnel investigations (W.S. 16-4-203(d)(xi))
- Juvenile records (W.S. 14-6-203, other statutes)
- Medical or psychological records (W.S. 16-4-203(d)(i))
- Peace officer videos (W.S. 16-4-203-(d)(xviii))
- Personal identifying information (W.S. 6-3-901; W.S. 16-4-203(a)
- Personnel and employment records (W.S. 16-4-203(d)(iii))
- Records of ongoing investigations (W.S. 16-4-203(b)(i))
- Security and emergency preparedness information (W.S. 16-4-203(b)(vi))
- Trade secrets and proprietary information (W.S. 16-4-203(d)(v))
- Court orders or sealed records
9. Can the City create or compile information for me?
Under Wyoming law, the City is not required to create a new record, perform analysis, or reformat data in response to a request.
10. What if I want to withdraw or change my request?
You may withdraw or modify your request at any time by contacting the Records Office at [email protected] or replying through the records request portal.
